Free property seminar – mortgagee sales, plus RMA & OIA shifts and impacts

Mortgagee sales are on the rise and – with interest rates staying stubbornly high, we can expect to see more over the next 12 to 18 months.

In addition, there have been recent amendments to the Resource Management and Overseas Investments acts that are impacting property development and funding.

For an update on both of these aspects from a legal perspective, please join us for this in-person seminar at our Lane Neave Christchurch office with senior lawyers Mat Martin and Jaxon Grieve.

We expect the seminar will be of interest to property professionals, investors, lenders and mortgage brokers.

Mortgagee sales – where’s the marketing heading and why

Mat is a civil and commercial litigation lawyer with specialist expertise in the mortgagee sale process. He’ll provide an overview of the process, along with common issues that arise. He’ll also spotlight some recent mortgagee sale court decisions and give his predictions on where the market is heading – and why.

“When it comes to mortgagee sales, we’re not at the levels we saw during the global financial crisis, however all recent indicators show that they’re on the rise.

“Failing to navigate the mortgagee sale process correctly can often drive up the stress levels for all parties involved so there are a number of things that parties need to carefully consider before proceeding.

“For example, mortgagees must be careful around exercising their rights and obligations under the mortgagee sale process. Meanwhile, for non-bank lenders, there’s an increasing trend of using the CCCFA as a grounds for re-opening credit contracts, and defeating rights of mortgagees.”

Impacts of recent changes to the RMA and OIA

Jaxon – an expert in commercial and property matters – will explore latest amendments to the Resource Management and Overseas Investments acts.

“I’ll be looking at how these changes impact the development and funding of property in the local landscape, plus provide practical insights and thoughts on changes yet to come.”
